General Terms

• Shipment Definition: A "Shipment" includes all parcels or pallets traveling under one waybill. The waybill incorporates these Terms and Conditions.
• Limited Liability: Shipments are transported on a limited liability basis. Additional insurance is available at extra cost for greater protection.

Customs, Exports, and Imports

1. Complete documents, amend codes, and pay duties or taxes.
2. Act as the Shipper’s forwarding agent for customs and export control and as Receiver for customs clearance.
3. Redirect the Shipment upon request.

Account Numbers

• Requirements: A valid Freshlux Express Logistics account number is required for all shipments unless payment is made by cash, cheque, or credit card at the time of shipment.
• Usage and Responsibility: Account numbers ensure proper invoicing, summarization of activity, and application of discounts. Account numbers are non-transferable and misuse may result in loss of discounts and/or service discontinuation. The account holder is liable for all charges.

Address Corrections

• Accuracy: If a recipient’s address is incorrect or incomplete, Freshlux Express Logistics will attempt to find the correct address but is not responsible for delivery delays under such circumstances. A surcharge will be applied for address corrections.

Deliveries and Undeliverable Shipments

• Undeliverable Shipments: If a Shipment is undeliverable, Freshlux Express Logistics will attempt to return it to the Shipper at the Shipper’s cost. If the Shipper cannot be contacted within five business days, the Shipment will be stored and possibly disposed of after 30 days if not collected.

Inspection of Shipments

Freshlux Express Logistics reserves the right to open and inspect any Shipment without notice.

Special Delivery Instructions

• Alternative Delivery: Special instructions for delivery to another location/person can be provided. Freshlux Express Logistics is not liable for loss or damage resulting from following these instructions. An administration fee may apply.

Method of Payment

Acceptable payments include cheque, Visa cards, cash, and electronic funds transfer (EFT). Note that some locations may not accept all payment methods.

Dimensional Weight (Volumetric Weight)

Dimensional-weight pricing applies to all shipments based on their size. The chargeable weight is the higher of the dimensional weight or the actual weight.

Service Charges and Delivery Schedules

• Saturday Service: Additional charges apply for Saturday deliveries.
• Storage Charges: Applied to shipments left unclaimed for more than five days.
• Same Day and Special Delivery Services: Available at additional charges.
• Re-packaging Services: Provided at a fee for shipments not packaged to standard.

Routing and Transit Times

Freshlux Express Logistics determines shipment routing and reserves the right to use other carriers. Transit times do not include weekends, public holidays, or delays beyond our control.

Shipper’s Obligations

• Accurate Information: Shipper must ensure that all shipment details, including weight and number of items, are accurate and properly labelled.
• Proper Packing: Shipments must be safely and carefully packed.
• Compliance: All applicable laws and regulations must be followed. Shippers are responsible for charges if the receiver or third party does not pay.

Liability and Claims

• Limits of Liability: Freshlux Express Logistics is not liable for damages beyond the stipulated limits and is not responsible for special, incidental, or consequential damages.
• Claims: Must be made within 24 hours of notification of loss or damage. Insurance is mandatory and claims are processed only if insurance was purchased at the time of shipment.

Delayed Shipments

Freshlux Express Logistics will make every effort to adhere to delivery schedules but is not liable for delays caused by incorrect information or other unforeseen circumstances.

Indemnity

Shippers shall indemnify and hold Freshlux Express Logistics harmless for any loss or damage arising from non-compliance with applicable laws or regulations.
